Go through every item on this list before paying any amount to any builder. Share this with your lawyer.

Verify MahaRERA Registration
Every new residential project in Maharashtra must be registered under MahaRERA. Ask the builder for the RERA registration number and verify it at maharera.mahaonline.gov.in. Never buy from an unregistered project.

Check Title Deed (7/12 Extract)
The Title Deed confirms the land is legally owned by the builder. Verify the 7/12 Extract (Satbara Utara) to ensure the land is in the builder's name, is NA (Non-Agricultural), and has no pending disputes or mortgages.

Encumbrance Certificate (EC)
Obtain an Encumbrance Certificate to confirm the property is free from all financial and legal liabilities — such as existing loans, court attachments, or unpaid dues. Your bank will also require this for loan approval.

Commencement Certificate (CC)
The Commencement Certificate is issued by the local authority permitting the builder to begin construction. Construction without a CC is illegal — and you cannot get a home loan or OC without it.

Approved Building Plan
Ask to see the sanctioned building plan from the local municipal authority. Verify that the floor, flat number, and area you are buying match the approved plan exactly.

NA Order (Non-Agricultural Land Certificate)
For plotted layouts and residential buildings, the land must have an NA (Non-Agricultural) conversion order. Building on agricultural land without NA approval is illegal and cannot be registered.

Sale Agreement — Read Every Clause
The Sale Agreement must clearly mention: total cost (no hidden charges), unit details, possession date, RERA number, penalty for delay, and refund policy. Have a lawyer review this before signing.

Builder's Track Record & CREDAI Membership
Research the builder's previous projects. Have they been delivered on time? Are residents satisfied? CREDAI membership is a positive indicator of ethical practices and accountability.

Occupancy Certificate (OC) — For Ready Properties
If buying a ready-to-move property, verify the OC has been received from the municipality. Without OC, the building is technically illegal, you cannot get a water connection, and banks may refuse loans.

Hire an Independent Property Lawyer
Never rely solely on the builder's lawyers. Hire an independent property lawyer to review all documents. A professional legal review typically costs ₹5,000–₹15,000 — a small price for a ₹30–₹60 lakh decision.
